Send a sealed copy of the petition to your spouse via post or a third party (not personally). If delivery fails, newspaper publication may be allowed. No service is needed for joint applications.

Set a Court Hearing Date
Apply to the Registrar for a hearing. The court confirms service and assigns your case as either:

Receive Decree Nisi
The court issues a temporary divorce order. No attendance is required if uncontested.

Receive Decree Absolute

Do You Need to State a Reason for Divorce?

Yes. The petitioner must show the marriage has “irretrievably broken down” as the legal reason for divorce.

Six weeks after receiving a decree nisi, you can apply to make it final by submitting Form 5 (for single petition) or Form 5A (for joint application).

If there are children, including those over 18 still in full-time education, the court must review their welfare before finalizing the divorce.

Once all requirements are met, the court issues the final divorce certificate (Decree Absolute).

If separated for at least 2 years, you can apply for divorce on your own, even without your spouse’s consent. Both parties must be in Hong Kong.

Not always. If you’ve been separated for over one year, you can file even without mutual consent. But agreements on custody and finances are recommended.

If there’s no agreement on custody or finances, or your spouse contests the divorce, legal advice is recommended.

You can remarry once the court issues the final Decree Absolute.
